Text Decisions on Matters of National Significance

The Resource Management Amendment Act 2005 replaced Sections 140-150 (Minister's Call-In Powers) with new sections outlining how Decisions on Matters of National Significance will be dealt with.

There are now several alternative processes, through which the Minister may deal with resource consent applications, notices of requirement for designations, private plan changes, or requests for the preparation of a regional plan. Options include:
  1. Ministerial call-in with a decision made by either the Environment Court or a board of inquiry

  2. Making a Crown submission

  3. Appointing a project coordinator

  4. Appointing a Hearings Commissioner

  5. Requiring a joint hearing to be held if more than one consent authority is involved

MFE's Improving National Leadership factsheet gives more details on these changes.
