Title Paokahu Trust v Gisborne District Council

Ref. Numbers A162/2003
Description Appeal on discharge permit for sewage outfall at Wainui Beach. Court agreed with iwi that discharge of waste in CMA inconsistent with tikanga maori and with sustainable management, and an affront to cultural sensitivity. Found no viable alternative to discharge, but ordered the Council to address ongoing desecration in a robust manner within 2 years.
