| Description |
Air discharge consent for expansion of the Stratford Power Station. EDS sought conditions requiring emissions to be offset by tree planting, and also that CO2 should be re-injected into depleted underground hydrocarbon reservoirs.
Both appeals were dismissed, the court deciding that it was inappropriate to impose a condition on either consent before national policy is in place to ensure a consistent approach. For a summary of these cases, see the Resource Management Bulletin, October 2002, p178-180.
